Just a day after their young son was rushed to the hospital after a pool accident, Usher's ex-wife Tameka Raymond is seeking an emergency custody hearing.

According to TMZ, the singer's ex filed papers in Fulton County, Georgia on Tuesday (August 6) alleging Usher is failing to take care of their two children by letting others care for them.

5-year-old Usher Raymond V was in the care of his aunt when he was stuck in a pool drain on Monday when the youngster went to reach for a toy underwater.

CPR was performed and though he is still hospitalized, he is expected to make a full recovery. The current custody agreement between the former couple grants Mr. Raymond primary custody of both kids, while Tameka has limited custodial rights.
